Castanet Web Design terms and conditions

The acceptance of a web development proposal forms a contractual agreement between the client and Castanet Web Design.

After a proposal has been accepted either verbally or by email, a non-refundable payment of half the agreed fee must be made before work begins.

All quotes are made on a basic of images and text being supplied by the client. CWD can take pictures at our own discretion but we are not obliged to. We can recommend professional photographers for quality promotional work and professional copywriters and translators.

It is the customer’s responsibility to ensure that their web site is lawful and does not infringe any copyright or any other laws.

CWD does not undertake to maintain or update a client’s website as part of the design agreement. If a client wishes, CWD will negotiate a maintenance contract based on the amount of work required. Maintenance may also be undertaken on a time and materials basis.

After updates have been made it is the client’s responsibility to check them and to ensure their accuracy.

If at any point during the website development a client wishes to cancel, they may do so but will be invoiced an amount that CWD believes to be proportional to the amount of work completed on the commission.

If, during the development, the client does not supply the content required in order to complete the commission within a reasonable amount of time, CWD will consider that the client wishes to cancel the commission.

CWD will at first place the client’s website on a demonstration server so that the client may view and comment upon its progress. When both CWD and the client agree that the website meets the criteria agreed during the commissioning process, CWD will invoice the client for the full amount due.

On receipt of payment, CWD will publish the website on the client’s domain. Once the client’s site is live and displaying as intended, CWD is not responsible or liable for the future functioning of the site unless a site warranty agreement has been entered into, however we are here to help and advise as needed. When a client agrees that a site can be made publicly available they are agreeing that the design and development of the site have satisfied all their requirements.

CWD cannot accept responsibility for any alterations caused by a third party occurring to the client’s pages once installed. Such alterations include, but are not limited to additions, modifications or deletions.

CWD is not responsible for any server downtime or problems arising from it.

Databases

If your website is database driven, it is recommended that the database be backed up regularly. This can be done through your hosting control panel using PHPAdmin. CWD is not responsible for backing up databases, however, we can advise and help if needed.

By agreeing to these terms and conditions your statutory rights are not affected.
